" 58-я статья состояла из четырнадцати пунктов.
Из первого пункта мы узнаём, что контрреволюционным признаётся всякое действие (по ст. 6-й УК — и бездействие), направленное… на ослабление власти…
При широком истолковании оказалось: отказ в лагере пойти на работу, когда ты голоден и изнеможён, — есть ослабление власти. И влечёт за собой — расстрел. (Расстрелы отказчиков во время войны.)

(Или вот ещё образец широкого чтения. Хорошо помню одну встречу в Бутырках летом 1946. Некий поляк родился в Лемберге, когда тот был в составе Австро-Венгерской империи. До второй мировой войны жил в своём родном городе в Польше, потом переехал в Австрию, там служил, там в 1945 и арестован нашими. Он получил десятку по статье 54-1-а украинского кодекса, то есть за измену своей родине — Украине! — так как ведь город Лемберг стал к тому времени украинским Львовом! И бедняга не мог доказать на следствии, что уехал в Вену не с целью изменить Украине! Так он иссобачился стать предателем.)

Пункт второй говорит о вооружённом восстании, захвате власти в центре и на местах и в частности для того, чтобы насильственно отторгнуть какую-либо часть Союза Республик. За это — вплоть до расстрела (как и в каждом следующем пункте).
Расширительно (как нельзя было бы написать в статье, но как подсказывает революционное правосознание): сюда относится всякая попытка осуществить право любой республики на выход из Союза. Ведь «насильственно» — не сказано, по отношению к кому. Даже если всё население республики захотело бы отделиться, а в Москве этого бы не хотели, отделение уже будет насильственное. Итак, все эстонские, латышские, литовские, украинские и туркестанские националисты легко получали по этому пункту свои десять и двадцать пять.

Шестой пункт — шпионаж, был прочтён настолько широко, что если бы подсчитать всех осуждённых по нему, то можно было бы заключить, что ни земледелием, ни промышленностью, ни чем-либо другим не поддерживал жизнь наш народ в сталинское время, а только иностранным шпионажем и жил на деньги разведок. Шпионаж — это было нечто очень удобное по своей простоте, понятное и неразвитому преступнику и учёному юристу и газетчику, и общественному мнению.
Широта прочтения ещё была здесь в том, что осуждали не прямо за шпионаж, а за:
ПШ — Подозрение в Шпионаже;
НШ — Недоказанный Шпионаж, и за него всю катушку! И даже за
СВПШ — Связи, Ведущие к Подозрению (!) в Шпионаже.
То есть, например, знакомая знакомой вашей жены шила платье у той же портнихи (конечно, сотрудницы НКВД), что и жена иностранного дипломата.
Но никакой пункт 58-й статьи не толковался так расширительно и с таким горением революционной совести, как Десятый. Звучание его было: "Пропаганда или агитация, содержащие призыв к свержению, подрыву или ослаблению Советской власти… а равно и распространение или изготовление или хранение литературы того же содержания". И оговаривал этот пункт в мирное время только нижний предел наказания (не ниже! не слишком мягко!), верхний же не ограничивался!
[...] Знаменитые расширения этого знаменитого пункта были:
— под "агитацией, содержащей призыв", могла пониматься дружеская (или даже супружеская) беседа с глазу на глаз, или частное письмо; а призывом мог быть личный совет. (Мы заключаем "могла, мог быть" из того, что так оно и бывало.)
— "подрывом и ослаблением" власти была всякая мысль, не совпадающая или не поднимающаяся по накалу до мыслей сегодняшней газеты. [...]
— под "изготовлением литературы" понималось всякое написанное в единственном экземпляре письма, записи, интимного дневника.
Пункт одиннадцатый был особого рода: он не имел самостоятельного содержания, а был отягощающим довеском к любому из предыдущих, если деяние готовилось организационно или преступники вступали в организацию.
На самом деле пункт расширялся так, что никакой организации не требовалось. Это изящное применение пункта я испытал на себе. Нас было двое, тайно обменивавшихся мыслями, — то есть зачатки организации, то есть организация! "

" Macbeth's self-justifications were feeble – and his conscience devoured him. Yes, even Iago was a little lamb, too. The imagination and spiritual strength of Shakespeare's evildoers stopped short at a dozen corpses. Ideology—that is what gives evildoing its long-sought justification and gives the evildoer the necessary steadfastness and determination. That is the social theory which helps to make his acts seem good instead of bad in his own and others' eyes, so that he won't hear reproaches and curses but will receive praise and honors. That was how the agents of the Inquisition fortified their wills: by invoking Christianity; the conquerors of foreign lands, by extolling the grandeur of their Motherland; the colonizers, by civilization; the Nazis, by race; and the Jacobins (early and late), by equality, brotherhood, and the happiness of future generations.... Without evildoers there would have been no Archipelago. "

" And as soon as you have renounced that aim of "surviving at any price" and gone where the calm and simple people go—then imprisonment begins to transform your former character in an astonishing way. To transform it in a direction most unexpected to you.
And it would seem that in this situation feelings of malice, the disturbance of being oppressed, aimless hate, irritability, and nervousness ought to multiply. But you yourself do not notice how, with the impalpable flow of time, slavery nurtures in you the shoots of contradictory feelings.
Once upon a time you were sharply intolerant. You were constantly in a rush. And you were constantly short of time. And now you have time with interest. You are surfeited with it, with its months and its years, behind you and ahead of you—and a beneficial calming fluid pours through your blood vessels—patience.

Formerly you never forgave anyone. You judged people without mercy. And you praised people with equal lack of moderation. And now an understanding mildness has become the basis of your uncategorical judgements. You have come to realize your own weakness—and you can therefore understand the weakness of others. And be astonished at another's strength. And wish to possess it yourself.
The stones rustle beneath our feet. We are ascending...
With the year, armor-plated restraint covers your heart and all your skin. You do not hasten to question and you do not hasten to answer. Your tongue has lost its flexible capability for easy oscillation. Your eyes do not flash over with gladness over good tidings, nor do they darken with grief.
For you still have to verify whether that's how it is going to be. And you also have to work out—what is gladness and what is grief.
And now the rule of your life is this: Do not rejoice when you have found, do not weep when you have lost.
Your soul, which formerly was dry, now ripens with suffering. And even if you haven't come to love your neighbors in the Christian sense, you are at least learning to love those close to you. "

" Thanks to ideology, the twentieth century was fated to experience evildoing on a scale calculated in the millions. This cannot be denied, nor passed over, nor surpressed. How, then, do we dare insist that evildoers do not exist? And whi was it that destroyed these millions? Without evildoers there would have been no Archipelago.
There was a rumor going the rounds between 1918 and 1920 that the Petrograd Cheka, headed by Uritsky, and the Odessa Cheka, headed by Deich, did not shoot all those condemned to death but fed some of them alive to the animals in the city zoos. I do not know whether this is truth or calumny, or, if there were any such cases, how many were there. But I wouldn't set out to look for proof, either. Following the practice of the bluecaps, I would propose that they prove to us that this was impossible. How else could they get food for the zoos in those famine years? Take it away from the workibg class? Those enemies were going to die anyway, so why couldn't their deaths support the zoo economy of the Republic and thereby assist our march into the future? Wasn't it expedient?
That is the precise line the Shakespearean evildoer could not cross. But the evildoer with ideology does cross it, and his eyes remain dry and clear. "
